Terms of Service
Last updated: May 15, 2025
1. Introduction
These Terms of Service govern your access to and use of SinarCloud products, websites, APIs, support services, and cloud infrastructure services. By creating an account, purchasing a service, or using SinarCloud, you agree to follow these Terms.
If you are using SinarCloud on behalf of a company or organization, you confirm that you have authority to accept these Terms for that organization.
2. Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement. You are responsible for ensuring that your use of SinarCloud complies with all applicable laws and regulations.
3. Account Registration and Security
You are responsible for keeping account credentials, API keys, billing contacts, and administrative access secure. Activity performed through your account is your responsibility unless caused by SinarCloud's proven failure to secure its systems.
You must notify us promptly if you suspect unauthorized access, compromised credentials, or misuse of your account.
4. Services and Acceptable Use
You may use SinarCloud services only for lawful purposes and in accordance with our Acceptable Policy. You may not attempt to disrupt, probe, overload, reverse engineer, or interfere with SinarCloud systems or other customers.
5. Service Availability
We work to provide highly available infrastructure, but no service can be guaranteed to be uninterrupted at all times. Planned maintenance, emergency maintenance, third-party provider issues, abuse mitigation, and events outside our control may affect availability.
Service-credit eligibility is handled under the Service Level Agreement (SLA).
6. Billing and Payments
Fees are billed according to the active plan, order, invoice, or service usage. You are responsible for all applicable charges, taxes, and payment-method validity. Billing terms are described in our Billing, Payment and Tax Policy.
7. Customer Content and Data
You retain ownership of the data, files, applications, databases, and workloads you place on SinarCloud. You grant SinarCloud the limited rights needed to operate, secure, support, and provide the services.
You are responsible for maintaining appropriate backups unless your purchased service explicitly includes managed backups.
8. Suspension and Termination
We may suspend or terminate access to services when required to protect the platform, comply with law, prevent abuse, respond to non-payment, or address violations of these Terms.
Where practical, we will provide notice and an opportunity to resolve the issue before suspension.
9. Limitation of Liability
To the maximum extent permitted by law, SinarCloud is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, or business interruption.
Our total liability for a claim is limited to the amount paid for the affected service during the period giving rise to the claim.
10. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated through the website, email, dashboard notice, or another reasonable channel. Continued use of SinarCloud after changes become effective means you accept the updated Terms.
11. Governing Law
These Terms are governed by the laws of the Republic of Indonesia, without regard to conflict-of-law principles.
